Terms of Use
These terms apply to your use of the Bombay Drum School mobile app (the "App"), run by Bombay Drum School, Shop No. 24, Gayatri Satsung, Thakur Village, Kandivali East, Mumbai 400101, India ("we", "us"). By signing in to the App you agree to these terms and to our Privacy Policy. If you don't agree, don't use the App.
These terms cover only the App. Your enrolment, fees, classes and studio conduct remain governed by your agreement with the school and the school's rules. If those rules conflict with these terms on studio use, the school's rules apply.
1. Eligibility and accounts
- The App is for students and staff of Bombay Drum School and its partner studios. School staff create accounts; you cannot sign up yourself.
- If you are under 18, a parent or lawful guardian must agree to these terms for you. They are responsible for your use of the App.
- You sign in with your mobile number and a one-time code. Keep your phone and codes private, and never share a code with anyone, including someone claiming to be from the school. You are responsible for activity on your account unless it happened because of our failure.
- Tell us right away at bombaydrumschool@gmail.com if you lose your phone, change your number, or think someone else has used your account.
- Your account is personal. Don't let others use it or make bookings for anyone else.
2. Bookings
- Each studio sets its own opening hours, slot lengths, room capacity, booking limits, how far ahead you can book, and cancellation cutoff. The App shows and enforces these rules, and staff may change them.
- A held slot is reserved only for a few minutes while you confirm. It is released if you don't finish booking in time.
- A shared slot can be joined by other students up to the room's capacity. A solo slot keeps the room for you alone and may count toward separate solo limits.
- You can cancel your own booking in the App up to the studio's cancellation cutoff. After that, contact the studio.
- Staff may cancel or move bookings, for example for maintenance, closures, holidays, safety reasons, or a breach of studio rules. We will try to tell you in the App or by notification.
- Staff can mark you as a no-show if you don't turn up. No-shows don't count toward your practice hours, and repeated no-shows may lead the school to limit your booking access.
- A booking in the App doesn't replace any fee, membership or payment rule the school has. The App doesn't take payments.
3. Notifications
If you allow them, the App sends reminders and booking alerts. They help, but you shouldn't rely on them alone: delivery depends on your device, its settings and third-party services. Always check your bookings in the App.
4. Acceptable use
You must not:
- try to access accounts, data or studios you aren't authorised for;
- book slots you don't intend to use, or hold or book slots in ways meant to block other students;
- use automated tools, scripts or bots with the App or its servers, or overload, disrupt, probe or reverse engineer them, except as the law allows;
- use another person's name or details, or misuse information you see about other students and staff;
- use the App for anything unlawful.
Staff accounts may be used only for running the school. Staff must keep student information confidential.
5. Suspension and closing accounts
The school may suspend, limit or close your account if you break these terms or the school's rules, if your enrolment ends, or if it's needed for security. You can ask us to delete your account at any time (see Delete account). Sections 7 to 10 continue to apply after your account closes.
6. Our App and content
We own the App, its design, logos and content, or have licences for them. We give you a personal, non-transferable, revocable right to use the App on devices you own or control, only for its intended purpose. The App's illustrations and store artwork are for presentation and may not show the actual studios.
7. Availability
We try to keep the App working and accurate, but we can't promise it will always be available, free of errors, or that a particular slot will be available. We may change, pause or stop parts of the App, for example for maintenance or updates. If the App is unavailable, contact the studio directly to book.
8. Liability
To the extent the law allows, the App is provided "as is". We are not responsible for losses caused by events outside our reasonable control, such as network or device failures, or third-party service outages, or for indirect or consequential losses. We are responsible only for losses that are a foreseeable result of our breaking these terms or our negligence. Our total liability to you for claims about the App is limited to ₹1,000, because the App is provided free of charge.
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or your rights under the Consumer Protection Act, 2019.
9. App stores
These terms are between you and Bombay Drum School, not Apple or Google. Bombay Drum School, not Apple or Google, is solely responsible for the App and its content, its maintenance and support, any warranties that apply by law, and any claims about it. That includes product liability claims, claims that the App fails to meet a legal or regulatory requirement, consumer protection or privacy claims, and claims that the App infringes someone else's intellectual property. We are responsible for investigating, defending, settling and discharging any intellectual property claim.
If you got the App from Apple's App Store:

- Apple has no obligation to provide maintenance or support for the App;
- if the App fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any (the App is free). To the extent the law allows, Apple has no other warranty obligation for the App;
- you confirm that you are not in a country under a US government embargo or designated by the US government as "terrorist supporting", and that you are not on any US government list of prohibited or restricted parties;
- you must comply with any third-party terms that apply when you use the App, such as your mobile network's terms;
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple may enforce them against you.
If you got the App from Google Play, Google Play's terms also apply to your download.
10. Law and disputes
These terms are governed by the laws of India. Before going to court, please contact us so we can try to resolve the issue. Subject to any rights you have under consumer protection law to bring a claim where you live, the courts of Mumbai, Maharashtra have jurisdiction.
11. Changes
We may update these terms when the App or the law changes. The date at the top shows the latest version. We will tell you in the App before important changes take effect. If you keep using the App after that, you accept the new terms.
